Terms of Service

1. Scope of service

XMRgate ("we", "us") provides a payment-gateway service that monitors public blockchains and the Monero network on behalf of approved merchants ("you"). We generate receiving addresses, watch for inbound transactions, maintain merchant balances, deduct platform fees, process payouts, and deliver signed webhooks.

2. Approval & eligibility

Access to XMRgate is approval-gated. By applying, you certify that the information you provide is accurate and that your business operates lawfully in its jurisdiction. We may decline, suspend, or terminate access at our discretion, particularly where the activity falls within a prohibited category.

3. No-log policy

We do not store customer or payer IP addresses, browser fingerprints, session tokens beyond authentication, or wallet-graph data. What we do store is enumerated on the privacy page. The no-log policy applies to XMRgate's own infrastructure and does not alter the inherently public nature of Bitcoin, Ethereum, Litecoin, or stablecoins on those networks.

4. Platform wallet processing and payouts

Buyer payments are received into XMRgate platform wallets, credited to your merchant balance after confirmation, and paid out to wallet addresses you configure. You are responsible for providing correct payout addresses and maintaining access to your own receiving wallets.

5. Prohibited categories

Merchants may not use XMRgate to process payments for: anything illegal in your jurisdiction or ours; mixing, tumbling, or laundering services; Ponzi, MLM, or pyramid schemes; unlicensed financial services; doxing or harassment-for-hire; CSAM and any exploitation material. This list is non-exhaustive and may be updated.

6. Merchant responsibilities

You are responsible for your own legal, tax, and regulatory compliance — including KYC where required of you. You are responsible for verifying webhook signatures before fulfilling orders, for the security of API keys you issue, and for the accuracy of the receiving addresses you configure.

7. Fees & billing

Per-transaction fees and optional monthly plans are listed on the pricing page. Fees are deducted from settled amounts where applicable. We reserve the right to update pricing with at least 30 days' written notice to affected merchants.

8. Service availability

We aim for high availability but do not guarantee uninterrupted service except where explicitly stated in an Enterprise SLA. Status, incident reports, and historical uptime are published on our status page.

9. Termination

Either party may terminate this agreement with reasonable notice. We may suspend access immediately if we detect activity that endangers merchants, the network, or the operation of XMRgate. On termination, active address history remains accessible for export for 30 days.

10. Limitation of liability

To the maximum extent permitted by law, XMRgate is not liable for indirect, incidental, or consequential damages, nor for any loss of crypto assets caused by chain reorganizations, network congestion, or actions of third parties (including wallet providers, exchanges, and block-explorer services).

11. Governing law

This agreement is governed by the laws of the jurisdiction in which XMRgate is established. Disputes will be resolved in the competent courts of that jurisdiction.

12. Changes to these terms

We may update these terms from time to time. Material changes will be announced via email and on the dashboard at least 14 days before they take effect.
