1. Scope of service
XMRGate ("we", "us") currently provides market information, integration documentation, and release-gated software to approved testers ("you"). Payment collection, merchant balances, fees, and payouts are unavailable unless the applicable rail is explicitly enabled after reconciliation and funded-canary approval.
2. Approval & eligibility
Access to XMRgate is approval-gated. By applying, you certify that the information you provide is accurate and that your business operates lawfully in its jurisdiction. We may decline, suspend, or terminate access at our discretion, particularly where the activity falls within a prohibited category.
3. Data minimization
We do not retain raw payer IP addresses in payment records. We may retain a one-way IP security hash, limited request metadata, authentication sessions, settlement records and other data needed for security and operation. The privacy page lists the relevant categories. This policy does not alter the public nature of non-private blockchains.
4. Platform wallet processing and payouts
Custodial payment processing is not currently available. If a rail is enabled later, its documented custody model, confirmation rules, reconciliation process, fees, and payout controls will apply. Deposit accounting remains locked pending transaction-output or token-log identity and reconciliation verification.
5. Prohibited categories
Merchants may not use XMRgate to process payments for: anything illegal in your jurisdiction or ours; mixing, tumbling, or laundering services; Ponzi, MLM, or pyramid schemes; unlicensed financial services; doxing or harassment-for-hire; CSAM and any exploitation material. This list is non-exhaustive and may be updated.
6. Merchant responsibilities
You are responsible for your own legal, tax, and regulatory compliance — including KYC where required of you. You are responsible for verifying webhook signatures before fulfilling orders, for the security of API keys you issue, and for the accuracy of the receiving addresses you configure.
7. Fees & billing
The pricing page describes intended plans for evaluation. No transaction fee is charged while payment rails are disabled. Production pricing, notice periods, taxes, and billing terms require a final operating entity and counsel-approved agreement.
8. Service availability
The service may be unavailable during development, validation, or maintenance. The status page publishes release-state declarations and an API health observation; it does not currently provide historical uptime or a contractual SLA.
9. Termination
We may suspend test access immediately when activity endangers users, networks, or XMRGate operations. Any production termination notice, data-export period, and balance-handling procedure must be defined in the final agreement before funded services are enabled.
10. Limitation of liability
To the maximum extent permitted by law, XMRgate is not liable for indirect, incidental, or consequential damages, nor for any loss of crypto assets caused by chain reorganizations, network congestion, or actions of third parties (including wallet providers, exchanges, and block-explorer services).
11. Governing law
The operating entity, governing law, venue, and required consumer or merchant notices are not yet finalized. This draft is not the production agreement and must not be accepted as one.
12. Changes to these terms
We may update these terms from time to time. Material changes will be announced via email and on the dashboard at least 14 days before they take effect.
